The services included and excluded are those specifically described in the detailed travel program, which forms an integral and essential part of this Agreement. The Agency acknowledges having received and accepted said program, including the daily breakdown of services, activities, and exclusions, and undertakes to communicate such information accurately to the Travelers.

Insurance coverage

The complete insurance information sheets are provided in advance to the agency and form an integral part thereof. For all terms, conditions, deductibles, and related details, reference shall be made to said information sheets

NOTE: The tourist tax, which applies to most accommodation facilities, is never included in the price of the travel package and must be paid on site or according to the instructions provided by the accommodation. The amount will be communicated before departure

Payment Terms (Multi-Day Travel Packages)

• Deposit: €300 per person (non-refundable), due at the time of booking
• First installment: 30% of the total amount (minus the deposit) — due 95 days before departure
• Final balance: due no later than 35 days before departure, in accordance with Art. 41 of the Italian Tourism Code

If the booking is made:
• Between 95 and 35 days before departure → 30% of the total amount is required at confirmation
• Less than 35 days before departure → full payment of the total amount is required within 24 hours of booking, to secure the services

Failure to comply with these deadlines may result in automatic cancellation of the booking and the application of cancellation penalties, as provided by law.

Unless otherwise agreed in writing, the above payment schedule applies to all bookings under this agreement. Specific exceptions may be established when required by suppliers (for example, to confirm non-refundable hotel reservations or advance payments for special services). In such cases, the revised payment terms shall be communicated in writing and shall prevail over the general schedule above.

Short description

 

1) Object of the Agreement

The present agreement regulates the sale and distribution of travel packages organized by Tuscan Experiences by Federica Zammarchi, which may be resold by to end customers under the conditions established herein.

2) Scope and Validity

This agreement refers exclusively to the travel package described in the attached program and quotation, valid for the specific travel period, services, and prices agreed between the Parties for the current edition. The agreed prices and conditions apply solely to this edition and validity period.
If the same package is proposed again for future dates or seasons, a new agreement shall be issued, which may include updated prices, services, or terms. Each booking confirmed under this agreement constitutes a separate and binding contract of sale between the Parties.

3) Bookings and Confirmations

The travel package covered by this agreement is scheduled for the specific dates indicated in the attached program and quotation. Within those dates, the Agency may collect bookings from its clients and forward the corresponding reservation requests to the Tour Operator. Each confirmed participant will be considered part of the same travel package and subject to the same conditions, services, and prices established herein. Bookings are considered final only upon written confirmation by the Tour Operator. All confirmed participants will be included under this agreement, which governs their participation in the package and related services.

4) Prices and Payments

The total price of the travel package, as defined in the attached quotation, applies exclusively to the present edition and validity period. Payment terms, cancellation penalties, and all related conditions are governed by the Tour Operator’s General Terms & Conditions, which form an integral part of this agreement. Unless otherwise agreed in writing, the standard payment schedule indicated in the Terms & Conditions shall apply. Specific exceptions may be agreed upon when required by suppliers (for example, to secure non-refundable hotel reservations or advance payments for special services). Any such exceptions shall be confirmed in writing between the Parties and shall prevail over the general payment terms.

5) Cancellations and Refunds

Cancellation policies, penalties, and refund conditions are governed by the Tour Operator’s General Terms & Conditions, available on the official website www.tuscanexperiences.com/terms-and-conditions, which form an integral part of this agreement by reference. The Agency acknowledges and accepts that the cancellation terms applicable to the travel package may also reflect specific supplier policies (for example, non-refundable hotel deposits or advance payments required to secure services). In such cases, these conditions shall prevail over the general cancellation terms and will be communicated in writing at the time of booking. All cancellation requests must be made in writing. The Agency remains responsible for the payment of any applicable penalties to the Tour Operator, regardless of whether or not the end customer has paid the Agency.

6) Travel Insurance

The Tour Operator informs the Agency whether or not travel insurance coverage is included in the specific package. When the package includes travel insurance, this will be explicitly stated in the related program and quotation, together with the relevant coverage details. In such cases, any refunds, reimbursements, or claims arising from events covered by the policy shall be handled directly between the traveler and the insurance company, according to the terms and procedures established by the insurer. The Tour Operator and the Agency are not responsible for the acceptance or outcome of such claims. When the package does not include travel insurance, the Tour Operator strongly recommends that travelers arrange suitable coverage for trip cancellation, medical assistance, luggage, and travel delays. Such coverage may also be arranged through the Tour Operator upon request.

7) Responsibilities

The Tour Operator acts as the organizer of the travel package and is responsible for the proper execution of the services included, according to the terms agreed with the Agency and the applicable provisions of Italian law. The Agency acts as an intermediary and is responsible for correctly presenting and selling the package to its clients in accordance with the information, descriptions, and materials provided by the Tour Operator. The Agency shall provide its clients with all mandatory pre-contractual and contractual information, ensuring that it corresponds to the official content of the package as communicated by the Tour Operator. The Tour Operator shall not be held liable for any misrepresentation, unauthorized modification, or omission by the Agency in the communication or sale of the package to the end customer. Any claims or complaints from travelers must be forwarded to the Tour Operator in writing by the Agency within reasonable timeframes, together with all relevant documentation.

8) Force Majeure and Extraordinary Circumstances

Neither Party shall be held liable for any failure or delay in performing its obligations under this agreement when such failure or delay results from force majeure or extraordinary and unavoidable circumstances beyond its reasonable control. Such events may include, but are not limited to: natural disasters, wars, civil unrest, epidemics or pandemics, government restrictions, strikes, extreme weather conditions, or any other event making it impossible or unsafe to operate the services as planned. In such cases, the Tour Operator will make every reasonable effort to offer alternative arrangements or reschedule the services, subject to the availability and cooperation of local suppliers. If rescheduling or alternatives are not possible, the Parties shall agree on any applicable refunds or credits in accordance with the Tour Operator’s General Terms & Conditions, published on www.tuscanexperiences.com/terms-and-conditions.
Each Party shall promptly notify the other of the occurrence of any such event and shall act in good faith to minimize the impact on the travelers and on the performance of the agreement.

This agreement is governed by the terms and conditions published on the Tour Operator’s official website www.tuscanexperiences.com/terms-and-conditions, which form an integral part of the present contract by reference.
The agreement is further governed, where applicable, by the provisions of the Italian Tourism Code (Legislative Decree no. 79/2011, as amended) and, subsidiarily, by the International Convention on Travel Contracts (CCV – Law no. 1084/1977).
The Agency, acting as intermediary, guarantees the accuracy and completeness of all travelers’ personal data provided to the Tour Operator and undertakes to indemnify and hold the Tour Operator harmless from any consequences arising from incorrect, incomplete, or false information.

The Agency, as contracting party, acknowledges having received from the Tour Operator all information and documentation necessary for the correct presentation and sale of the travel package to its clients, including the program, quotation, and Terms & Conditions available on www.tuscanexperiences.com/terms-and-conditions.

The Agency undertakes to use such information accurately and to provide it in full to its clients, in compliance with its own obligations under the Italian Tourism Code and any applicable consumer protection laws.

 

Validity of Proposal


This proposal, submitted by the Agency, shall be deemed irrevocable and binding for a maximum period of seven (7) days from the date of submission, unless otherwise agreed in writing between the Parties.

Pursuant to Regulation (EU) 2016/679 (GDPR) and Legislative Decree 196/2003 as amended, the personal data of the Agency’s representatives and of any travelers whose data are provided for the execution of this agreement will be processed by the Tour Operator, both manually and electronically, solely for purposes related to the performance of the contract, the fulfillment of legal obligations, and, where applicable, for legitimate business communication regarding services similar to those covered by this agreement. Providing personal data is necessary for the conclusion and execution of the contract. Refusal to provide such data may make it impossible to deliver the services included in the travel package. Data subjects may exercise their rights under Articles 15–22 of the GDPR at any time by contacting the controller via email, PEC, or phone.

 

Legal Framework

This agreement is governed by Italian law and, for all matters not expressly regulated herein, by Legislative Decree no. 79 of 23 May 2011 (Italian Tourism Code), as amended, in so far as applicable to the relationship between organizer and intermediary, and, subsidiarily, by the International Convention on Travel Contracts (CCV – Brussels, 23 April 1970).

Organizer’s Responsibility

The Tour Operator acts as the organizer of the travel package and is responsible for the proper execution of all services included in the package, even when performed by third-party suppliers, in accordance with the terms of this agreement and applicable law.

Withdrawal, Modifications, and Substitution of Services

The Agency, as contracting party, may withdraw from this agreement under the conditions and penalties set out in the Tour Operator’s General Terms & Conditions, available at www.tuscanexperiences.com/terms-and-conditions, or under any specific written terms agreed between the Parties. Should any essential element of the package become unavailable or require modification before departure, the Tour Operator will promptly inform the Agency and may propose:

• a substitute service or package of equivalent or higher quality at no additional cost, or

• if no suitable alternative can be provided or is not accepted, a refund limited to the portion of the price corresponding to the services not supplied.

In the event of service unavailability during the execution of the package for reasons not attributable to the Tour Operator, the same principles shall apply. The Agency undertakes to inform its clients (the travelers) of any such modifications or refunds, ensuring full compliance with its own obligations as intermediary.

Insurance and Guarantees

The Tour Operator is covered by civil liability insurance with Nobis Compagnia di Assicurazioni S.p.A., policy no. 203925172. In compliance with Article 47 of the Italian Tourism Code, financial protection for advance payments and, if necessary, repatriation in case of insolvency is guaranteed through guarantee fund policy no. 203925169, also issued by Nobis Compagnia di Assicurazioni S.p.A.

Jurisdiction

For any dispute arising from this contract, the exclusive jurisdiction shall be the Court of Siena (Italy).
