The furnished one-bedroom apartment, located on the first floor at Via di Collazzi, 10, 53045 Montepulciano (SI), consists of a kitchen/living room, a bedroom, and a bathroom. It is registered in the Land Registry of the aforementioned municipality on map sheet 117, parcel 273, sub. 27 (category A/4, class 2, rooms 2.5), APE 0000557968 (Class F - APE copy available for the tenant).

The landlord guarantees, and the tenant agrees, that the systems serving the property and, if applicable, the condominium, comply with the safety regulations in force at the time they were installed.
The lease agreement will be governed by the following terms:
Condition of the Property
The tenant declares to have inspected the premises and found them in good maintenance condition and suitable for the agreed use. The tenant agrees to return the leased property in the same condition as received, except for normal wear and tear, under penalty of compensation for damages.
Duration of the Lease and Occupancy
The contract is stipulated for the period indicated above, at the end of which it will terminate automatically without the need for any notice, which is deemed to have been given in advance.
Purpose of the Property and Prohibition of Subletting
The property is to be used exclusively as a residential dwelling for tourism purposes only. The tenant is not allowed to sublet or lend the unit, in whole or in part, under penalty of automatic contract termination. The tenant commits to accommodating only the persons listed in the agreement.
Any replacement of persons during the rental period is prohibited unless previously agreed upon.
The presence of more people than agreed will result in contract termination under Article 1456 of the Italian Civil Code and require the tenant to pay the landlord an amount equal to the total agreed rental fee as a penalty under Article 1382 of the Italian Civil Code, including retention of the security deposit.
The landlord grants the tenant the right to use the property, including furnishings and accessories. The provision of meals, beverages, security, cleaning, tidying, or maintenance of the premises and furnishings is expressly excluded, as these are the sole responsibility of the tenant.
Rental Fee
The rental fee, taking into account the objective conditions of the property as described and its location, is agreed as indicated above. The landlord grants the tenant the right to use the property, including furnishings and accessories.
The provision of meals, beverages, security, cleaning, linen change, tidying, or maintenance of the premises and furnishings is expressly excluded, as these are the sole responsibility of the tenant. The rental fee includes: Initial cleaning; First supply of bed linen and towels; Water, gas, and electricity; Use of available appliances and accessories; Heating;
Check-in, Check-out, and Access to the Premises
Both parties agree to inspect the premises on arrival and departure. The landlord reserves the right to access the rented accommodation for necessary maintenance.
Unless otherwise agreed, check-in is allowed between 2:00 PM and 6:00 PM on the agreed start date, and check-out must be completed by 10:00 AM on the final day. In any case check-in will be strictly by appointment, agreed in advance by both parties
Upon arrival, the tenant must present identification documents for all booked guests to allow registration with the Public Security authorities.
Access to the accommodation may be denied in the following cases:
Discrepancies between the booking details and the tenant; Missing identification documents; Non-payment of the balance or security deposit.
Security Deposit and Complaints
To guarantee all obligations under this contract, including the return of the property at the end of the lease, the tenant shall pay the landlord a refundable security deposit of € ________ (via ________). The deposit is not deductible from the rent.
The security deposit will be refunded at the end of the lease, subject to inspection of the property, furnishings, and compliance with all contractual obligations.
The deposit will cover any damages caused to the property and furnishings by the tenant. If damages exceed the deposit amount, the tenant remains liable. Any defects in the property or furnishings must be reported to the landlord within 24 hours of key collection.
Significant damages or compensation claims must be promptly reported in writing. Complaints not submitted before departure will not be accepted. The tenant must allow the landlord reasonable time to resolve any reported issues.
NB: No security deposit is required for rentals made through AIRBNB.
Disclaimer
Upon receiving the keys, the tenant assumes responsibility for the property during their stay and expressly releases the landlord from any liability for direct or indirect damages caused by other tenants or third parties.
Condominium Rules
The tenant agrees to comply with the building’s regulations. In any case, the tenant must not engage in activities or behaviors that may disturb other residents. The tenant may be evicted if they behave contrary to basic civil etiquette or violate the terms of this contract and the condominium regulations.
Immediate eviction will result in the loss of all amounts paid, without prejudice to further claims for damages.
Modifications to the Property
The tenant may not make any modifications, improvements, or additions to the property, its intended use, or existing systems without prior written consent from the landlord.
Early Termination
If the tenant returns the keys before the agreed lease term ends, the rent already paid will not be refunded.
The tenant must leave the kitchen in order, with washed dishes and cookware, as these are not included in the general cleaning fee.
Domicile
For all legal purposes of this contract, the tenant elects domicile at the rented premises. If they vacate the property, domicile is considered to be at the municipal office where the property is located.
Authorization for Data Communication
The landlord and the tenant mutually authorize each other to communicate their personal data to third parties in relation to obligations connected with the rental agreement (Legislative Decree 196/03, integrated by Regulation (EU) 2016/679 - GDPR).
Reference to Legal Provisions
For any matters not covered by this contract, the parties exclusively refer to the provisions of the Civil Code and local customs.Any modification to this contract cannot take place and cannot be proven unless in written form
