With reference to the persons listed above, and reiterating that this contract is governed by the terms and conditions previously made available and accepted, as well as by brochures, leaflets, the website(s) of the Tour Operator and any other descriptive documentation provided regarding the package tour — it is hereby acknowledged that such documentation shall be deemed known and accepted by the contracting parties, pursuant to Article 1341, paragraph 1 of the Italian Civil Code, and may not be contested on the grounds of lack of awareness.

This contract is also governed by the International Convention on Travel Contracts (CCV), ratified by Law no. 1084/1977, and by the Italian Tourism Code (Legislative Decree no. 79/2011, as amended).

The Agency, acting as intermediary, expressly guarantees the accuracy and completeness of the travelers’ personal data communicated to the Organizer, and undertakes to indemnify and hold the Organizer harmless from any consequences arising from incorrect, incomplete, or false information provided.

The Agency, as contracting party, declares that, prior to submitting this offer, it has been provided with access to all pre-contractual information required under Article 34 of the Italian Tourism Code, including the standard information form (Annex A), as published in the Terms and Conditions.

 

The Tour Organizer hereby confirms the availability of the services requested by the contractor, for the purpose of concluding the present package tour contract, concerning the following:

Included and Excluded Services

The services included and excluded are those specifically described in the detailed travel program, which forms an integral and essential part of this Agreement. The Agency acknowledges having received and accepted said program, including the daily breakdown of services, activities, and exclusions, and undertakes to communicate such information accurately to the Travelers.

NOTE:

The deposit must be paid within 24 hours from the signing of this contract; failing such payment, the contract shall be deemed null and void. The booking will be confirmed only after the transfer has been received and validated.

Balance Payment Terms
Payment Terms (Multi-Day Travel Packages)

• Deposit: €300 per person (non-refundable), due at the time of booking
• First installment: 30% of the total amount (minus the deposit) — due 90 days before departure
• Final balance: due no later than 28 days before departure, in accordance with Art. 41 of the Italian Tourism Code

If the booking is made:
• Between 90 and 28 days before departure → 30% of the total amount is required at confirmation
• Less than 28 days before departure → full payment of the total amount is required within 24 hours of booking, to secure the services

Failure to comply with these deadlines may result in automatic cancellation of the booking and the application of cancellation penalties, as provided by law.

Exceptions to these terms may apply if previously agreed with Tuscan Experiences by Federica Zammarchi.

This proposal is made by the client as irrevocable and binding for a maximum of 7 from the date of submission, unless otherwise agreed in writing.

Pursuant to Article 13 of Legislative Decree 196/2003, the personal data of the signatory of this contract and of any additional participants — the provision of which is required to ensure access to the services included in the purchased package tour — will be processed manually and/or electronically in accordance with applicable regulations. Refusal to provide such data will make it impossible to conclude the contract and deliver the relevant services. Unless otherwise indicated (also available on the organiser's or seller's website), the data controller is TUSCAN EXPERIENCES by Federica Zammarchi, Case Sparse Querciole Primo, 8 – 53023 Castiglione d’Orcia (SI), Italy – VAT 01574000525 – REA 221926 CCIAA Arezzo-Siena – PEC: federica@pec.federicazammarchi.net – Email: customercare@tuscanexperiences.com – Phone: +39 379 2349338. Where necessary, data may be shared with competent authorities, insurers, correspondents, local representatives of the organiser or seller, service providers included in the package, or any third parties required to complete the contract and deliver the agreed services. It may also be disclosed to tax, legal, or accounting consultants in order to comply with legal obligations or to exercise rights in legal proceedings. The controller may use the email address provided to promote or sell services similar to those covered by this agreement, unless the data subject objects now or at any time. All rights under Article 7 of Legislative Decree 196/2003 may be exercised at any moment by contacting the controller by email, phone, or PEC.

 

Legal Framework

This contract is governed by Legislative Decree no. 79 of 23 May 2011 (Italian Tourism Code), Articles 32–51, and by the International Convention on Travel Contracts (CCV – Brussels, 23 April 1970), where applicable.

Pre-contractual Information

All pre-contractual information, including the standard information form (Annex A), forms an integral part of this agreement and cannot be altered without mutual consent, in accordance with Article 35 of the Italian Tourism Code.

Organizer’s Responsibility

The organizer is responsible for the performance of all services included in the package, even when provided by third parties, as stated in Article 42.

Right of Withdrawal and Modifications

The Agency, as contracting party, has the right to withdraw before departure under the conditions and penalties set out in Articles 41 and 42 of the Italian Tourism Code. In the event of significant changes to essential elements of the package, or price increases exceeding 8%, the Agency may terminate the contract without penalties and shall be entitled to a full refund of the amounts already paid. Such refund will be issued without undue delay and in any case within 14 days of termination. The Organizer may also propose a substitute package of equivalent or superior quality at no extra cost; if not accepted by the Agency within the specified time limit, the refund will proceed under the same terms. The Agency undertakes to communicate the above rights and conditions to the Travelers.

Service Substitution and Refund

If, either prior to departure or during the execution of the package, one or more of the contracted services becomes unavailable due to supplier unavailability or other justified reasons not attributable to the Organizer, the Organizer reserves the right to substitute such service with another of equivalent or superior quality, at no additional cost to the Agency. If the proposed substitution is not accepted, or if no equivalent alternative can be provided, the Agency shall be entitled to a refund of the portion of the price corresponding to the service not provided. The Agency undertakes to inform the Travelers of any such substitution or refund.

Insurance and Guarantees

The organizer is covered by civil liability insurance with Nobis Compagnia di Assicurazioni S.p.A., policy no. 203925172. In compliance with Article 47 of the Italian Tourism Code, financial protection for advance payments and, if necessary, repatriation in case of insolvency is guaranteed through guarantee fund policy no. 203925169, also issued by Nobis Compagnia di Assicurazioni S.p.A.

Assistance

In accordance with Article 45, the organizer is required to provide adequate assistance to the traveler in case of difficulty, without undue delay, except where the issue is caused by the traveler’s negligence or intentional misconduct.

Jurisdiction

For any dispute arising from this contract, the exclusive jurisdiction shall be the Court of Siena (Italy).
